Lemon Law News – Brake Line Problems Prompt Piaggo Recall

Piaggo Group Americas, the American subsidiary of the Italian motorcycle manufacturer Piaggo, is recalling more than 1,000 vehicles after finding a problem with their anti-lock brake systems.

The manufacturer sent a safety recall report to the National Highway Traffic Safety Association (NHTSA) on June 15, but amended that report on June 26 expanding the initial recall from 714 to 1,139 vehicles.

Vehicles affected by the recall include the 2016-2017 Moto Guzzi V7 III Racer 750, V7 III Stone 750, V7 III Special 750, V9 Bobber and V9 Roamer built between Nov. 2, 2015 and May 31, 2017.

Piaggo states in its safety recall report the models in question contain anti-lock brake hoses that can move out of position. The lines can then rub against the engine’s secondary air system connection, which can make brake hose leak fluid. This can compromise the brake system’s effectiveness and increase crash risk.

The manufacturer said no crashes or failures related to this defect have occurred at this time.

Piaggio will notify owners and dealers will secure the front ABS brake hose, preventing it from rubbing. Any hose that has already been damaged will be replaced. The repairs will be made free of charge. The recall is expected to begin in June 2017. Owners may contact Piaggio customer service at 1-212-380-4433. Concerned Piaggo consumers may also visit the NHTSA’s website, and enter their VIN to see if their vehicle is included in any recalls.

Lemon laws vary from state to state as to whether they cover motorcycles, but the federal Magnuson-Moss Warranty Act covers motorcycles regardless of state.

The manufacturer of your vehicle is legally required to fix any recalled problems for free. If the dealership refuses to fix the part or tries to charge you for the repair, contact the manufacturer immediately. The Highway Safety Act of 1970, which created the NHTSA, requires motorcycle manufacturers to pay for the recall and replacement of a defective part.

If the manufacturer fails to repair, replace, repurchase, or provide your recalled vehicle’s loss value, they are violating the warranty and a lawyer may be able to help you.

Lemon law attorneys help their clients by dealing directly with the manufacturer on the clients’ behalf, working to promptly resolve the issue and get their clients back on the road. Thanks to the Magnuson-Moss Warranty Act, attorneys can seek their fees directly from the manufacturer, meaning a client can obtain legal counsel without having to pay attorneys’ fees directly out of pocket.
