Lemon Law News – Brake Light Corrosion Leads to Hyundai Recall

Hyundai Motor America announced June 7, 2017 they will recall more than 160,000 Genesis and Sonata vehicles for problems involving their parking brake indicator lights.

The manufacturer notified the National Highway Traffic Safety Administration (NHTSA) the recall will involve 161,074 2015-2016 Hyundai Sonata and 2015-2016 Hyundai Genesis vehicles.

These vehicles come equipped with an electrical switch which illuminates when the parking brake is engaged. Electric switch corrosion can damage the brake warning, making it not properly illuminate when the brake is applied.

This could cause the driver to drive with the brake still applied, affecting vehicle acceleration. Drivers could notice sound coming from the brakes as well as smoke and smell caused by brake friction.

The company said they first learned about the issue on May 12, 2017 following direction from Korea’s Ministry of Land, Infrastructure and Transport that the company should conduct a safety recall in the Korean market. Hyundai decided on May 26, 2017 to conduct a worldwide recall.

Hyundai said they are not aware of any accidents or injuries related to the defect.

Hyundai will notify owners and dealers will replace the parking brake switch free of charge. The recall is expected to begin on June 30, 2017. Owners may contact Hyundai customer service at 1-855-671-3059. Hyundai’s number for this recall is 164. Hyundai owners can also visit the NHTSA’s website and enter their VIN to see if their vehicle is included in any recalls.

Your vehicle’s manufacturer is legally required to fix any recalled problems for free. If the dealership refuses to fix the part or tries to charge you for the repair, contact the manufacturer immediately. The Highway Safety Act of 1970, which created the NHTSA, requires car manufacturers to pay for the recall and replacement of a defective part.

If the manufacturer fails to repair, replace, repurchase, or provide your recalled vehicle’s loss value, they are violating the warranty and a lawyer may be able to assist you.  Lemon law attorneys help their clients by dealing directly with the manufacturer on the clients’ behalf, working to promptly resolve the issue and get their clients back on the road. Thanks to the Magnuson-Moss Warranty Act, attorneys can seek their fees directly from the manufacturer, meaning a client can obtain legal counsel without having to pay attorneys’ fees directly out of pocket.
